A BILL to amend article one, chapter seven of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section thirteen, relating to authorizing county commissions to impose a motor vehicle registration license fee for each vehicle owned by a resident of the county; and imposing a misdemeanor criminal penalty in the form of a fine for failure to register.

Be it enacted by the Legislature of West Virginia:
That article one, chapter seven of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section thirteen to read as follows:
ARTICLE 1. COUNTY COMMISSIONS GENERALLY.

§7-1-13. Authority to require registration for motor vehicles; misdemeanor penalty.

The county commission of any county is hereby authorized andempowered to require by order entered of record that no person may locate, place or maintain any motor vehicle in such county for more than thirty days until the owner of such motor vehicle has first obtained a registration license permit to do so from the assessor of such county. Such license permit shall be for information purposes and an application for any such permit shall be made upon such forms as may be prescribed by the assessor. A fee not exceeding twenty dollars, to be fixed by the county commission by order entered of record, may be charged by the assessor for the issuance of any such license permit. All fees so collected shall become a part of the county treasury.
Any person violating any such county commission order shall be guilty of a misdemeanor, and, upon conviction thereof, shall be fined not less than five hundred dollars. Magistrates shall have concurrent jurisdiction with courts of record with criminal jurisdiction of any offense under this section.



NOTE: The purpose of this bill is to authorize county commissions to impose a motor vehicle registration license fee in the amount of $20.00 for each vehicle owned by a resident of the county. It makes it a misdemeanor not to register, with a fine or penalty of not less than $500.00.
